What To Tell Your Divorce Attorney Even If You Don’t Want To

If you are going to go through a divorce and have decided to hire a lawyer, you will probably be asking yourself if you need to confess certain things in your past. There are some things you would perhaps rather not talk about at all, but remember, your lawyer needs to be prepared to fight for you. At any rate, as you try to decide what to tell your divorce attorney, console yourself with the thought that everything you tell him will be confidential. If the following things apply, make sure your lawyer finds out from you.

1. Tell your lawyer if you have a reputation for certain things. You don’t want these to come out and surprise him during the divorce. Have you ever been accused of having an affair? Do people think you are a flirt? Do people think you have a temper? Your lawyer would be better prepared with a strategy to deal with potential hot spots if you warn him beforehand.

2. Your spouse and you have common friends. Be honest with your lawyer and tell him which of your common friends would testify for you and against you. If possible, make a list of your common friends and try to classify them according to whether they would have something to say against you or for you.

3. Never lie about having a criminal record. If you committed some illegal acts as a minor, your records may have been expunged. However, some people may remember and there is nothing to bar them from testifying against your character. Rest assured, your own lawyer would not bring your past up, but he has to be ready in case someone else does.

4. If you have ever been treated for a mental or psychological problem, be sure to let your lawyer know. The same goes for being treated for any type of addiction such as alcoholism. If you were ever hospitalized or placed in a treatment center, or if you ever attempted to commit suicide at any time, your lawyer needs to know.

5. Did you ever have any trouble with Child Protection Services? If you are thinking of what to tell your divorce attorney, this is one of those things you must never neglect to inform him about.

6. Do you have other children outside of this union? Are you supporting them? This is important information and may have bearing on your capacity for custody.

7. Have you ever committed any act of violence against any person? Think carefully and make sure you recall anything that can be construed as violence. If you slammed a few plates out of anger, this may not seem violent to you but others can perceive it as such. Remember, too, that verbal abuse is a form of violence.

8. If you have ever been involved in any other litigation, you need to tell your lawyer about it. It may no longer seem important or worth mentioning to you but it can still be used against you. You must also let your lawyer know about the results of those litigations.

9. Include in your confession any incidents involving the abuse of prescription drugs and the use of illegal drugs. Do not exempt from your disclosure any event which, in your mind, is defined only as “recreational use” of drugs.

10. Likewise, you should disclose any adulterous, any homosexual relationship you ever had. The same goes for any sexually transmitted disease – even if these occurred outside of your marriage. In the same manner, if you gave birth or got pregnant outside of marriage, this has to be made known to your lawyer as well.

Making a list of what to tell your divorce attorney is part of preparing for your divorce. Go right ahead and tell your lawyer even if some things may seem embarrassing for you. If your lawyer is experienced in his field, he won’t blink at what you say. He has probably heard it all anyway.
